BZA Follows-Up On Waffle House Probation Plus More…

As you may recall, the Waffle House on Stone Ave. is on probation in terms of complying with the special permit granted by the Board of Zoning Appeals (BZA) earlier this year. A status report about this probation is to be given at the next BZA meeting.
Below is the public notice:

The City of Greenville Board of Zoning Appeals will hold a Public Hearing on Thursday, December 16, 2010 at 4:00 PM in the 10th floor Council Chambers at City Hall for the purpose of considering the following Applications:

A. S 10-85, Special Exception granted 6.17.2010 to Waffle House, Inc (WH Capital, LLC, Owner) to operate a restaurant between the hours of 12 Midnight and 5:00 AM located at 11 E. Stone Avenue in a ‘C-2′, Local Commercial, District – Report from the Administrator reviewing the Applicant’s adherence to the terms of the Permit and the Greenville City Code (TMS #’s 0035000401700 and 0035000401800).

B. V 10-168. Application of Quik Trip Corporation in behalf of North End, LLC, Owner, for Variances to Sections: 19-4.4.2 (D) (1), Location of Accessory Structures;19-5.1, Table of Dimensional Standards; and, 19-6.5.4 (A) ((6) (a), Parking Lot Location and Design, pursuant to Section 19-2.3.7, Variance Permit, of the Greenville City Code to allow the development of a Convenience Store that will not comply with: the dimensional requirements for principle and accessory structures; and, the location and design criteria for off-street parking. The property is located at 40 Rutherford Street in an ‘RDV’, Redevelopment, District (TMS #’s 0011000100200, 0010000103400, 0010000102003, and 0010000102002).

C. A 10- 173. Application of LaShunda Garrison in behalf of 3rd World (Trish, LLC, Owner) appealing the Decision of the Administrator pursuant to Section 19-2.3.16, Appeals from Decisions and Interpretations of Administrator, denying an application pursuant to Section 19-4.1, Table of Uses, to establish a ‘Nightclub / Bar’ located at 704 W. Washington Street in an ‘RDV’, Redevelopment, District (TMS # 0017000200301).

D. A 10-187. Application of William I. Benton in behalf of Gregory T. and Kristen A. Brown (Owners) appealing the Decision of the Administrator pursuant to Section 19-2.3.16, Appeals from Decisions and Interpretations of the Administrator, directing the Owners to cease operation of “Puppy Luv Doggy Daycare” pursuant to Sections 19-4.1.1 (D) (1), Prohibited Uses, Table of Uses, and 19-4.4.2 (C) (1), Accessory Uses and Structures. The premises are located at 10 McDonald Street in an ‘RM-1′, Single and Multifamily Residential, District (TMS # 0035000103202).

E. S 10-193. Application of Mark Sullivan for a Special Exception pursuant to Section 19-2.3.5, Special Exception Permit and Section 19-4.1, Table of Uses, of the Greenville City Code to establish a ‘Nightclub / Bar’ located at 300 River Street in an ‘C-4′, Central Business, District (TMS # 0060000300324) .

F. S 10-194. Application of Liana Shimizu in behalf of Pelham Court, LLC, Owner, for a Special Exception pursuant to Section 19-2.3.5, Special Exception Permit and Section 19-4.1, Table of Uses, of the Greenville City Code to establish a ‘Restaurant Serving Alcoholic Beverages’ located at 115 Pelham Road in a ‘C-1′, Neighborhood Commercial, District (TMS # 0279000101000).
